Former Yeovil Town midfielder Marc Bircham has launched legal action against his insurers following the injury that ended his career. The Queens Park Rangers Youth Team coach and former player hung up his boots on January 3rd 2009 after an ankle injury failed to clear up, leaving him sidelined at Huish Park.
Bircham is suing Lloyd's syndicate Marketform for a total of £874,273 under an insurance policy he had taken out against his career being ended early. According to the Insurance Times he submitted his claim on January 9th 2009, but Marketform rejected it claiming that "there had been a breach of warranty and/or material non-disclosure"
Through his lawyers, Bircham disputed Marketform's rejection of his claim last November, and with the insurers refusing to budge, the QPR Youth Team coach has now commenced High Court proceedings against Marketform. Their representative Simon Turner states that the case has already gone through independent arbitration in order to resolve the issue:
"The original claim that was presented we feel we rejected on a valid basis, and that's been upheld by an independent arbiter."
Bircham agreed to sever his contract with Yeovil Town on January 30th 2009 after making just 18 appearances in 18 injury-riddled months at Huish Park, comprising of back and hamstring problems. But his ankle injury in Autumn 2008 proved to be terminal, with his last game for the club coming in September 2008 in the 3-0 defeat at MK Dons. Three months later he retired from the game.
There's no suggestion that Yeovil Town are in any way impacted by this legal action, with their severance agreement with Bircham entirely separate from his insurance arrangements.
